NEW DELHI: With Prasad Nagar police station facing flak for poor handling of the siblings sex abuse case, the central district police have decided to transfer the case to the womens' cell of the district. They will also write to the Child Welfare Committee (CWC) to assign an independent member who will assist the investigations, claimed sources in the central district deputy commissioner of police's office.
The decision comes after a local court directed the police to assign a senior police officer, along with the investigating officer, in the shocking gangrape and sodomy case so that all the accused are apprehended at the earliest.
Sources in the police said the victims and their mother met DCP (central) Jaspal Singh late on Monday night and demanded the case be handed over to the CBI or the crime branch for a ''fair inquiry''.
However, when Times City contacted him on Tuesday, Singh refused to say much.
''We are doing the needful. We cannot comment on an investigation where both the accused and the victims are mostly minors. Once a rape case is registered, it cannot be annulled, not even if the victim's party apply for it unless the court agrees to it. We are trying to ascertain the identity of the two other accused as we did not find anyone with that name studying in Class IX of that school,'' said the officer.
However, Subhas Nagaar, the social worker who helped the victims' mother lodge the case, said: ''It's true that the identity of one of the absconding minors is difficult to establish as he does not study in the same public school where the victims' studied. But the other accused is the son of a teacher in the same school. We have information that this minor is attending school every day."
Nagar added: "As for the other accused, they are all residents of Karol Bagh and their families own successful businesses in the area. There is an obvious attempt to cover up the incident by only projecting the driver as a monster.''
A woman, who complained of being tortured by her in-laws despite giving a hefty dowry, found herself in trouble as a Delhi court has ordered filing of a criminal case against her and her family for giving dowry. Additional chief metropolitan magistrate Lokesh Kumar Sharma directed SHO Shahdara to register the FIR on a complaint filed in the court by a harried husband.
In the complaint filed through counsel Gagan Preet Singh and Karan Vir Singh, the man referred to the allegations made by his wife before the Crime Against Women (CAW) Cell of Delhi Police that huge dowry was paid in her marriage. PTI
Delhi Police rapped for filing dowry cases without proper probe

A day after the Supreme Court held that a person cannot be convicted for merely demanding dowry, the Delhi High Court Friday pulled up the Delhi Police for registering a case of dowry against a person without carrying out a proper probe.
While granting bail to a person arrested under the dowry act, Justice S.N. Dhingra observed that before registering an FIR, the police must investigate the allegations levelled against a person in a detailed manner.
As per the prosecution, the complainant in the case, Ramesh Chand had alleged his daughter Geeta's brother-in-law, Jaipal and sister-in-law used to physically harass her. Geeta had married Mahadev Feb 16.
In his complaint, Ramesh Chand mentioned that during marriage, his daughter's father-in-law demanded a car which they could not give. After two months of the marriage, Mahadev started beating her. Also according to prosecution, Geeta's brother-in-law also harassed her, asking her to bring more dowry. Geeta committed suicide June 26.
While submitting his bail plea before the court, Jaipal contended that he did not demand anything either from Geeta or from any other member of her family.
'He was not involved in any act pertaining to the cruelty for any demand of dowry. There is absolutely no allegation in the entire prosecution story that the petitioner was involved in committing any act which can be covered under the four corners of the sections 498-A (Husband or relative of husband of a woman subjecting her to cruelty) and 304-B (dowry death) of IPC (Indian Penal Code),' submitted Amit Sahney, his counsel.
He also said that the police registered a case against him only on the allegations of Ramesh Chand. 'Police could not find anything incriminating against him. The entire story of the prosecution is based on surmises and conjectures and there is absolutely nothing on record against him,' he submitted.
The Delhi High Court has awarded a compensation of Rs. 40,000 to a man who was off-loaded by immigration authorities from an aircraft here on the basis of a look-out circular issued by the NCW, saying statutory bodies are not empowered to initiate criminal proceedings.
The High Court said that the compensation award has to be equally shared by the National Commission for Women (NCW) and Foreigners Regional Registration Office (FRRO) for de-boarding Vikram Sharma, against whom no FIR was lodged in connection with a matrimonial dispute.
Mr. Sharma had approached the court alleging that the FRRO had acted illegally in off-loading and detaining him here in April 2008 at the instance of NCW where his wife had filed a complaint.
“This court is of the view that the action of NCW in writing to the DCP, FRRO for the issuance of LOC (look-out circular) against Sharma was without the authority of law. The consequent action of FRRO (which) resulted in the petitioner (Sharma) being detained at IGI airport on April 8, 2008 was also illegal,” Justice S. Muralidhar said.
The court asked the Ministry of Home Affairs (MHA) to issue clarification orders within three months stating that a request for issuance of LOC cannot emanate from statutory bodies like NCW, NHRC as well as National and State Commission for Protection of Child Rights which are vested with the powers of a civil court.
“The NHRC, the NCW, the NCPCR (National Commission for Protection of Child Rights) have not been vested with the powers of a criminal court and do not have powers to enforce criminal law,” Justice Murlidhar said.
“They should bring the necessary facts to the notice of law enforcement agencies like the police, which will then make a request for issuance of LOC upon an assessment of the situation and strictly in terms of the procedure outlined for the purpose,” he said.
Mr. Sharma had alleged that he was “made to stand in solitary confinement in a toilet” and his passport was stamped with the remarks “Off loaded-deported due to criminal complaint”.
The court while accepting the plea of Sharma ordered removal of remarks from his passport.
When the incident had occurred, the NCW was seized of a complaint against Mr. Sharma in which his wife had expressed apprehension that her husband might flee the country to avoid the mediation process pending before it.
The NCW had sent a request for issuance of the look-out circular when the petitioner expressed his inability to appear before it.
Mr. Sharma had submitted that the Crime Against Women (CAW) cell of Delhi Police had also issued an LOC against him on his wife’s complaint, but the same was later withdrawn after the case was transferred to Anti Extortion Cell of Delhi Police.
VADODARA: A woman cop from mahila police station was caught allegedly accepting a bribe of Rs 500 from a complainant on Thursday. Assistant sub-inspector Laksmi Parmar was arrested by the anti-corruption bureau (ACB) when she was accepting bribe from Raju Shrimali. Shrimali had approached the ACB officials two days ago when Parmar asked him to dole out cash for making some documents.
This is for the first time that a woman cop from mahila police station that was established last year was caught accepting bribe. According to ACB officials, Shrimali's wife Hema had registered complaint against him for demanding dowry in 2009. The couple had got married in 2008. "Shrimali was called to the mahila police station on Tuesday for investigation. Parmar told him that he will have to give Rs 500 cash for preparing some documents," said ACB officials.
"Shrimali told her that he is poor and doesn't have money, but she kept insisting for money. She even threatened to arrest him. So, he approached ACB following which we laid a trap," the officials added.
