New Delhi: Munish Dalal became a national hate figure when his pretty and vivacious bride-to-be, Nisha Sharma, accused him of demanding more dowry on the eve of their marriage.
Ms Sharma was feted by the world’s press as an icon of feisty Indian womanhood for reporting her fiance to the police under the country’s anti-dowry laws.
These laws are aimed at tackling the husbands and in-laws who, even though they have received a dowry on marriage, abuse and torture a woman afterwards so that she asks her parents to hand over yet more cash and consumer durables.
Figures from 2012 show that one woman dies every hour in India over demands for more dowry.
The crime is so common that the law allows the police to arrest a man the moment his wife alleges that he demanded more dowry. No evidence has to be produced. Bail depends on the discretion of the judge. The man is considered guilty until he can prove his innocence.
But in a ruling this week, the Supreme Court said the police cannot arrest a man on the basis of an allegation. Condemning the law’s misuse by ''disgruntled'' wives ''as a weapon rather than a shield'', the court said the police must give reasons for the arrest that would then be examined by a magistrate.
''The ruling on arrests is long overdue. False cases had become an epidemic. We used to call it legal terrorism. Now men can sleep more peacefully,'' said Rohit Girdhar, a co-ordinator with the Save the Family Foundation in New Delhi, which has campaigned for the law to be amended.
Mr Girdhar, who was falsely accused by his wife but acquitted by the courts in 2012, said the foundation has thousands of victims whose ''poisonous and vindictive'' wives used the law to blackmail them into giving a fatter alimony, settle scores, ruin their name or to get custody of the children.
One man who went to the foundation recently for counselling was a New Delhi music teacher. Mr Girdhar claims that the teacher’s wife was mentally unstable from the day he married her and kept false accusations of infidelity against him. Five years ago, as their marriage crumbled, she walked into the local police station to accuse him of demanding more dowry.
''That man’s entire family has been devastated. It took just one vicious woman to do it. He and his elderly parents have been running around the courts for eight years. By the time the verdict comes, it will be too late for this man. He has been damaged too much, he has lost his faith in people,'' Mr Girdhar said.
For women’s rights groups, given the high levels of violence against women, the ruling is retrograde. Brinda Karat, general-secretary of the All India Democratic Women’s Association, said she was opposed to the dilution of a law that had come after years of debate and struggle.
''Dowry is rampant, worse than ever before. I oppose any law being misused but our studies show that men do get bail. Why is the Supreme Court not equally concerned about the women who are brutally murdered over dowry?'' Karat said.
For Mr Dalal, the ruling is sweet vindication. After being painted as a national villain a decade ago, in 2012, he was cleared by the courts. It turned out his fiance had been in love with another man.
''She didn’t want to marry me but was scared of her parents. By accusing me falsely, she was trying to get out of the marriage without incurring their anger,'' Mr Dalal said.

NEW DELHI: The Supreme Court has ruled that leveling wild allegations repeatedly by one spouse against the other could inflict mental agony and it would be a ground for the aggrieved person to move court seeking divorce citing "irretrievable breakdown of marriage".
Nearly seven years ago, the Supreme Court had formulated "irretrievable breakdown of marriage" as a ground for grant of divorce to couples and had suggested to the legislature to amend the law to provide statutory backing to this new ground for dissolution of marriage.
On Monday, a bench of justices SJ Mukhopadhaya and Dipak Misra added to that judgment and said leveling of wild allegations inflicts humiliation and affects the reputation of the aggrieved spouse.
Affirming the decree of divorce granted to Dr BV Ravi, an associate professor in a government hospital, the bench said his wife had been making wild allegations which portrayed him to be gender insensitive. The court also noted that she had been, without reason, refusing to go to live with him with their child and making false charges against his relatives.
Writing the judgment, Justice Misra said: "Marriage as a social institution is an affirmation of civilized social order where two individuals, capable of entering into wedlock, have pledged themselves to the institutional norms and values and promised to each other a cemented bond to sustain and maintain the marital obligation."
Justice Misra said different persons react differently to similar situations. "What could be mental cruelty in the life of two individuals belonging to particular strata may not amount to mental cruelty in respect of another couple belonging to a different stratum of society."
Referring to the wife's conduct, the bench said: "From this kind of attitude and treatment it can be inferred that the husband has been treated with mental cruelty and definitely he has faced ignominy being an associate professor in a government medical college. When one enjoys social status working in a government hospital, this humiliation affects the reputation and self-respect."
Despite the breakdown of marriage, the bench kept in mind the interests of the 16-year-old son of the couple and said it was the father's "bounden duty to provide for maintenance and education" of the child. Excluding the amount already paid to the wife, the court asked the husband to pay Rs 25 lakh to her in six months for the purpose of education of the child.
It directed the Bangalore family court to keep the money in a nationalized bank in the joint account of the child and mother, who can draw the interest to spend on her son's education.

India saw a paradigm shift in the crimes against women in the aftermath of the Delhi Gang Rape in December 2012. The only story that seemed to be in print, on air and in our minds and hearts was the story of a paramedical student who died after a brutal gang rape. The momentum is still ripe with thousands of debates, seminars and discussions happening everyday around the nation on how to prevent crime against women. Women empowerment and safety has become a political issue, with each party making these a prime agenda in their manifesto.
The stringent law brought in a year ago in the wake of the Delhi Gang Rape expanded the ambit of sexual assault but, as is being realised now, left it open to misuse. Mulayam Singh Yadav of the Samajwadi Party got into trouble when he revealed the ‘other side’ of the rape story. Justice Virender Bhat while acquitting four people in a gang rape case in Delhi made an observation that it was becoming “difficult to distinguish fake cases from genuine ones”. However, he had to bear the brunt of stating the truth as many feminist organisations went on record to say that he needed “gender sensitization training”. Justice Kailash Gambhir said that the rape law was frequently being used as a tool for “vengeance and vendetta” to harass, extort and blackmail males.
The mere statement of a woman becomes gospel truth and the accused gets arrested and charge-sheeted. Even the frail, old and weak persons are not spared against the false accusation of rape. The saddest part is that just because of being a woman, she gets the benefit of doubt. Being a feminist, I cannot be against the empowerment of Indian women. But yes, I am strongly against the cheap attitude of such women who manipulate the Indian laws in their favour. This is because the misuse of these laws not only ruins the reputation of the falsely accused and his family, but also weakens the case of those women who have really gone through any molestation. It is true that men need to respect women, but it is equally important that women must respond accordingly.
An RTI response filed with the Delhi Police reveals that from 2008-2013, out of 27 complaints registered at 6 Police Stations under the New Delhi district, 11 cases were that of ‘rape with promise of marriage’. It is not only making a mockery out of the sacred institution of marriage, but also inflating statistics of rape which further depreciates our own society.
Many people will question my opinion that many laws are misused, why raise voice against this. The truth is that those laws don’t destroy families. These do! Moreover, justice cannot be based on gender of an accused or victim. Such cases become huge media trials for the accused and the victim’s name is kept out of media. Same is the case with dowry laws where a huge misuse is being made every single day. No doubt laws are made for our protection but their gross misuse is ruining families and the very fabric of our society.
We as a society are now witnessing administrative matters turned into rape, office politics turned into rape drama and rape law becoming a tool for blackmail, revenge and extortion! Similarly, dowry law is being used for abuse of men and their elderly parents who then have to pay through their nose to settle these cases or rot in jail. The worst part is that if men are acquitted it is not reported in media and by then his family has suffered the most horrible punishment. To sift the chaff from wheat requires sensitivity of lawmakers not only towards women but equally towards men because both in tandem form this society. It is important that we demand gender-just, gender-sensitive and not only gender-neutral rape laws.
By misuse of these laws we are only further endangering and deepening women’s vulnerability in the country. Let us stop this legal terrorism and ensure the strictest punishment meted out to perpetrators of crimes against women as well as women who misuse these laws. Ultimately, injustice anywhere is a threat to justice everywhere. Women’s groups and civil society also need to introspect whether these laws are not being made a mockery of and whether they are demanding justice or merely media space.
Because respect cannot be demanded, it can only be commanded.

Failure of live-in relationship or young adults acting immaturely by getting into commitments that end up in break-ups are among major reasons for increase in rape cases, the Delhi High Court has observed. The court also cautioned parents of young couples to behave with "more sensitivity" while dealing with such issues.
A bench of justices Kailash Gambhir and Sunita Gupta made the observation while upholding the life term awarded to four members of a Delhi-based girl's family, including her father, for killing her lover as they did not approve of their relationship.
Anguished over the killing of the 24-year-old youth, the bench said young adults, especially girls, need to be more responsible and act maturely when taking important decisions like getting married or entering into a live-in relationship. "The need of the hour is that boys and more importantly girls have to be very careful and cautious before taking such an important decision concerning their lives before entering into the most sanctimonious relationship of marriage or even to have live-in relationship. "One of the major reasons contributing to increase in the rape cases is failure of live-in relationship or any immature decision on the part of such young adults which more often end up in a broken relationship but sometimes after indulging into physical relationship," it said.
However, this placed an implied onus on the shoulders of the persons involved in such relationships to act responsibly and maturely, it said.
Parents are "expected to behave with more sensitivity and maturity as such issues need to be resolved with patience, understanding and tolerance and instead of indifference or with a bent of mind of alienating the two", the court said. "It is often noticed that any impetuous act to smother such relationships often has a backlash in the form of resentful feelings or even rebellious actions.
"Therefore, it is with great sensitivity that the parents need to acknowledge the growing independence of their children and rationally and dispassionately deal with these emotive issues giving due respect to their feelings," the bench added.
24-year-old Kuldeep was stabbed to death on the evening of October 14, 2006, by his lover's father, Ravi Kumar and her three uncles Karamvir, Raj Kumar and Sanjay at Uttam Nagar in west Delhi.
According to the prosecution, the four had acted with the common intention of eliminating Kuldeep as they believed he had damaged their reputation because of his affair with Ravi's daughter. The court also agreed with this view that the four acted with the common intention of killing Kuldeep, as Karamvir and Raj had immobolised the victim by holding his arms and legs and Sanjay stopped anyone from coming to the aid of the youth while Ravi stabbed him seven times with a knife. The trial court on June 6, 2011, had awarded life term to all the four after holding them guilty of murder.
While upholding the trial court decision, the high court also said, "Kuldeep perhaps would not have met such a tragic end and these accused persons perhaps would not have suffered severity of punishment of life imprisonment had they acted in a sensible and mature manner with due patience, tolerance and understanding to resolve the things instead of taking the law in their own hands."

'Bramhakumari' arrested for extorting Rs 7 lakh from elderly man by filing false rape case

BHOPAL: Madhya Pradesh police on Friday caught a woman and a lawyer for extorting a sum of Rs 7 lakh from an elderly man by allegedly threatening him to implicate him in a case of rape. This incident took place in Gwalior district on Friday evening.
The accused woman had joined the Bramhakumaris six years ago, after separating from her husband, said police adding that she had filed similar complaints against other people also.
They were arrested red-handed while collecting money from the man, they were threatening to implicate, said police.
Earlier this month, accused Rekha Rajak, 33, lodged a complaint with Mahila police station that she was raped by Ram Nivas Sharma, 69, head of Brahma Kumaris' ashram, resident of Thatipur area in Gwalior. She told police that she was exploited for long and then raped by the accused during her three-month stay at the ashram.
The extortion angle came up in the case when Sharma, who has been accused by the women of committing rape, lodged a counter complaint.
While police initiated investigations and booked Sharma, she offered a deal of Rs 7 lakh to Sharma to withdraw the complaint.
Sharma informed the matter to police and continued negotiations with the woman. Mayank recorded the telephonic conversation and handed it over to the police.
Unaware of the police complaint, the woman asked Sharma to deposit Rs 5 lakh in her bank account and hand over remaining amount to the lawyer.
"We have arrested the woman and her accomplice for registering a false case of rape against Sharma and collecting Rs 7 lakh extortion money," Gwalior SP Pramod Vermatold TOI.
Sum of Rs 5 lakh (with its series number given by Sharma) were recovered in the bank, Rs 2 lakh was seized from her accomplice, the SP added. Police claim she had made similar complaints against other people including her father-in-law.
"It seems that she has made false complaints in the past also. We are investigating it," said the SP.
Senior police officials claim that there had been several instances, especially in the Bundelkhand region of Madhya Pradesh, where women have misused the law as a "weapon for vengeance and vendetta".
"Many of the cases are being reported by those women who have consensual physical relationship with a man but when the relationship breaks due to one reason or the other, the women use the law as a weapon for vengeance and personal vendetta to extort money and sometimes even to force the man to get married to her," said a senior police officer quoting a remark by Delhi high court.
While granting anticipatory bail to a man facing rape charges filed by a woman claiming to be his wife in May 2013, Delhi high court had said that judges should "cautiously examine the intentions of the girl to find out whether the rape complaint is genuine or has malafide motives".

SURAT: A resident of Ved Road in the city attempted suicide by consuming poisonous material on Wednesday following alleged torture by his wife and in-laws. Father of two sons alleged that his wife took help of goons to thrash him repetitively. Wife and her family were allegedly forcing the husband to discontinue relation with his family.
Mahesh Pardhi, married to Chandrika around 12 years ago and the couple has two sons. A jari worker, Pardhi, consumed poisonous material at his residence and attempted to kill self. He was shifted to a hospital and currently under treatment in critical condition.
He wrote a suicide not before attempting suicide in which he alleged that his wife, brother-in-law, father and mother-in-law have repeatedly tortured him during past few years. Demanding discontinuation of relation with his family Pardhi was thrashed by his wife. Pardhi was pressurised by his wife to stop meeting his mother, sister and brother. His wife thrashed him number of times, Pardhi alleged.
Pardhi alleged that his wife called goons to thrash him. His brother-in-law, mother and father-in-law thrashed him forming a group. Recently Pardhi's wife approached police after which he was threatened by her of police actions. Police are now investigating the case.

New Delhi: A court here has observed that dowry prohibition law cannot be allowed to become a tool for harassment.
Granting relief to a man, who was booked in a dowry harassment case by his wife, the court ordered investigation against the complainant for filing a false case.
The man's wife in July 2012 filed a first information report (FIR) against him in a South Delhi police station, alleging that he demanded dowry and subjected her to cruelty, which resulted in her miscarriage.
Police investigated the complaint and filed a cancellation report, giving a clean chit to the accused.
Metropolitan Magistrate Shivani Chauhan, accepting the cancellation report of Delhi Police, said Sections 498A (subjecting woman to cruelty) and 406 (criminal breach of trust) and Dowry Prohibition Act are special legislations enacted for the "protection of women" and have serious penal consequence for the offender.
"Under no circumstances can it be permitted to become a tool for harassment of innocent persons," the magistrate said.
"There is a enough material on record to show that the complaint was false and fabricated."
During the investigation it was revealed that it was the woman's second marriage and there was no evidence of dissolution of the first.
The woman alleged cruelty by the man which had resulted in her miscarriage. But the court noted that the investigation report showed she had voluntarily got the medical termination of her pregnancy.
It was observed the woman had mentioned the name of the other man in the medical report. The bills of hospital were cleared by the other man.

Save Indian family (SIF) A name which few people would have heard or cared about 9 years back, but today this is a force to reckon with. The membership of SIF has reached lakhs across the world. Most of the prominent members of SIF come from well-educated and respected families.
(SIF) also has a large number of women supporters who have joined the movement realizing the pain and trauma men and their families go through in Indian society. Many of these women supporters have been victims themselves as sisters, mothers and mother-in-laws. These ladies themselves were falsely implicated due to gender biased laws that are wife-centric. Members of (SIF) aim to protect men and women from extortionist wives, corrupt Police officials and biased judiciary.
This is a true story of a man, Bharat. In 2005, Bharat was a hard-working young man, who jumped through many hoops to make a successful career as a scientist. He was raised to believe that a good man puts women and children first, protects and provides for his family, respects women, and endures pain and sacrifice without heaving a sigh.
Unfortunately, he was unaware of a fact that good men are often at the receiving end of abuse; until he himself became a victim of spousal violence and witnessed societal apathy towards men like him. To add to his woes, he also became victim of gender biased law IPC Section 498A, a law which gave undue credibility to his wife, and treated him as guilty until he could prove himself innocent. He was arrested and imprisoned for a crime he did not commit. He had to witness his parents and siblings being jailed for no fault of theirs. He lost his job and suffered unbearable pain due to separation from his child. Having lost all hope, he ended his life at a tender age of 28. In local dailies, news of his death was flashed as "A scientist ends his life due to financial problems.”
Bharat’s story is just one of more than 68000 thousand men in India, whose thankless lives taken away every year just when they are ready to blossom. Statistics from the National Crime Records Bureau show that every 9 minutes one married Indian man committed suicide unable to withstand verbal, emotional, economic and physical abuse and legal harassment.
An unanswered question from (SIF) to all social activists and law makers: Is the Pain of A Mother or Sister any less when they lose their Son or Brother?
In the last 150 days (SIF) and its associated 35+ NGOs all over India, have been mentioned in the media in 60 different articles. If every article has been read by at least 100,000 people, then about 8 million people across the world would have known or heard about (SIF) and that is something to be proud of.
We believe in the teachings of Mahatma Gandhi and we get our inspiration from this great man. We believe in his words "First they ignore you, then they mock you, then they fight you, then you win "!!
(SIF) is aware of the odds stacked against it. (SIF) knows very well that media and other industries would love to see more family break ups, because family breakups increase spending and this further drives up the demands for the goods and products. "A united family will own one TV while a dived family will need two is the simple reasoning.”
However (SIF) knows it will win, because (SIF) is on the same side as truth is and we believe that "Truth Always Wins"(Satyamev Jayate).
(SIF) may not have the blessing of the Government of India, but we do have the blessings of thousands of mothers, grandmothers and sisters who work and fight with us day in and day out trying to educate the slumbering Indian populace.
(SIF) has the support of hundreds of small but nevertheless important NGOs who work with us to spread the word on how gender biased laws are destroying Indian society. We all try to wake up the people of India to bring about gender equality in the society.
We know we will win and we will succeed in creating a Ministry for the Welfare of Indian Men .
We know that the night is darkest before the sun shines and the (SIF) has no doubt that the sun will shine and spread the rays of hope, peace and family harmony that will keep the Indian family as a cohesive unit for the next ten thousand years.
On this occasion, (SIF) would also like to review the present status of men in Indian society and highlight the need to accord men the privileges and protections that they rightly deserve as fellow humans.
Thousands of men are becoming victims of "legal terrorism" unleashed by the misuse of Indian Penal Code Section 498A, Protection of Women Against Domestic Violence Act, adultery laws, laws against rape and sexual harassment, and even divorce, maintenance and child custody laws.
The Universal Declaration of Human rights states that "all are equal before the law, and are entitled without any discrimination to equal protection of the law". Article 14 of the Indian Constitution declares that "The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India." However, the Government of India has not made any provisions to protect men against any form of domestic abuse or harassment at the work place.
The Universal Declaration of Human Rights also proclaims that "everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law." However, women-centric laws in India presume that the accused man is guilty until he can prove his innocence, thus violating the presumption of innocence and the principles of fair trial which is guaranteed under Articles 20 and 21 of the Constitution of India, in addition to defying the Universal Declaration of Human Rights.
(SIF) has been working hard to sensitize the public to these serious issues, and to urge the Government to take appropriate measures to alleviate men's woes in the present times.
