AHMEDABAD: The Gujarat HC on Thursday slapped a penalty of Rs 1 lakh on Dashrath Devda, president of Akhil Bharatiya Patni Atyachar Virodhi Sangh for protesting against alleged misuse of domestic violence laws. A division bench fined him for filing frivolous PIL and for wasting court's time.

Devda had approached the HC by way of filing a PIL demanding judicial interference in the alleged misuse of protection laws for women. He was demanding a protection in legislation for men, who are according to him henpecked by their wives.

Devda has been claiming that women have abused the laws, which are in favour of them, but certain protection for men is also required against the misuse of the legislation. He filed this PIL, which came up for hearing before a division bench. When Devda began arguments as party-in-person, the court asked him to withdraw his PIL because his demand was to amend the legislation. Refusing to pay any attention to what the court was hinting at, Devda continued to argue how women in this country are worshipped, and no law is required for their protection. However, the chief justice repeatedly asked him to withdraw the PIL.

Ultimately, the court imposed a fine of Rs 1 lakh on Devda and asked him to pay the money to the Self Employed Women's Association — an NGO working for women empowerment. The court has directed Devda to pay the amount of penalty within two months.

Devda and members of his association often stage demonstrations and take out rallies in the city in protest against the domestic violence laws. They also help men in court proceedings, who face charges of domestic violence from their spouses. In this PIL also, Devda tried to assert their views that different pieces of legislation favouring women are misused, and ultimate sufferers are the family members. The association has been protesting against anti-dowry law of Section 498A of IPC, alimony related provisions in Section 125 of CrPC and the Protection of Women from Domestic Violence Act.

MYSORE: The Ashodaya Samithi, an organization helping sex workers and University of Mysore highlighted various forms of violence, harassment and exploitation faced by women in society, on Thursday. The event was held to observe international day for elimination of violence against women. It emphasized on the fact that decline in human values has led to various problems faced by women in society.

Southern police range departmental enquiry cell DySP Dharanidevi Malagatti said where there are no human values there will be more exploitation and harassment. Violence against women is always a violation of human rights and is still prevalent in society.

Demanding salary from women, restricting women's freedom, forcing women to go for work, etc., all amounts to crime under Domestic Violation Act. The fairer sex is still tolerating various kinds of harassment in their places of work and at home, said Dharanidevi and sought an end to violence against women.

Sociology department chairman Gururaj B felt the need to accelerate efforts to educate people, particularly those from the lower and middle classes, as they are usually the silent victims of harassment and exploitation.

Expressing concern over the misuse of laws, the chairman claimed that 75% of cases filed against men for harassment is false. Quoting a report of mid-1990s, he stated that over 1.25 lakh women had committed suicide over harassment in India, whereas the number of men who ended lives over similar charges had crossed 1.5 lakh. "We need to take a re-look at the dealings of Domestic Violence Act and Section 498a of the IPC. Also the women's movement should focus more on protecting families than fighting against men," he stated.

Has the equation in the war of the sexes changed

Strange it may sound,but the National Crime Record Bureau (NCRB) figures released by a city-based mens rights advocacy group shows that the number of married men ending their lives is far more than their female counterparts.And the group claims that the men to women suicide ratio of 65:35 indicates that it is the men can now don the tag of the oppressed sex.

The data was revealed on the World Mens Day by the Indian Family Foundation,a global movement started by the families of Indian men facing abuse in the hands of their wives.According to the figures mentioned in the report in 2008,57,639 married men across the country killed themselves,compared to 30,224 married women.Every nine minutes,an Indian husband commits suicide.Men contribute to 92 % taxes but face 100% ignorance, an organization member said.

The organization pointed out that most of the men who ended their lives were often ridiculed as being weak and irresponsible and denied any support or counselling.No one believes that men can be victims of domestic violence.But a survey shows that in the past 12 years,1,70,000 married men have committed suicide,as they could no longer bear the domestic strife, Zaveri added.

The organization blames the phenomenon on the fact that the world has turned a deaf ear to all the complaints coming from men.There is no limit to the expectations from a man.The unaddressed domestic abuse and family disputes are taking a huge toll on married men.No one shares their pain and there is no social support system for these distressed men, an organization member said.In spite of the suicide of the doctor from Lucknow who left behind a suicide note accusing his wife and in-laws of cruelty,no action has been taken by the police.

The group is now urging the government to start a ministry for men and also a National Commission for Men on the lines of the ones that exist for women.If there can be a government organization for women,children and even animals,we deserve to have one as well, Zaveri said.

Demanding the arrest of Rakhi Sawant in connection with the recent controversy on her TV show, a group of male activists from the Indian Family Foundation (IFF) came together on International Men’s day on Friday, raised the grievances of men and spoke about the alleged misuse of women-centric laws in the country.

“If a woman was called impotent on national TV, we are sure that the National Commission for Women would have ensured that the male host was behind the bars,” says Bunty Jain, vice-president, IFF. “We are not against women but we are looking for gender neutrality in the country,” says Jain.

According to the National Crime Records Bureau, in the last 12 years, 1,70,000 married men have committed suicide due to domestic violence. Reflecting upon the rising figures of suicide rates among Indian husbands, the IFF questioned this bias and demanded separate machinery to record complaints by men under cognisable offences.

Milind Chindarkar’s wife committed suicide on February 18, 2010, and it has been established in the post-mortem report that her death was due to hanging. His sister told DNA, “Our family is falsely accused in abetting her suicide. He has not been proven guilty but is undergoing imprisonment for nine months. He is not getting bail on the grounds that he might tamper with evidence once he’s out. We have lost my sister-in-law already, we are fearful of losing my brother.”

In another case, on October 3, 2008, Husain Ali Khan’s wife Alimunisa left home, and after eight months, accused the family of cruelty under section 498 (A) of the Indian Penal Code (husband or relative of a woman subjecting her to cruelty) in April 2009. She has demanded maintenance charges of Rs25,000 per month, and a flat. Khan’s sister Shaheeda says, “We hadn’t even asked her family for dowry.”

“Since laws in the country favour women, men’s trust in marriage is decreasing, giving way to live-in relationships,” says Jinesh Zaveri, activist with the IFF.

Why not a national Commission for men?

This is a very legitimate demand to protect men. In the name of women empowerment, Govt of India is harassing men. The NCRB suicide rate of men and women is an eye-opener evidence that men are being harassed from all sides : from Govt to police to judiciary. Especially the suicide rate of married men. Suicide rate of men and women before marriage is almost same. But after marriage the suicide rate of men is double that of women. Where any suicide and accidental death of women after marriage is termed as dowry death men suicide is not recognized at all and hence there is no forum for men to knock at for help.

CHENNAI: On the occasion of International Men's Day on Friday, the All India Men's Welfare Association (AIMWA) reiterated its demand to the Union Government that a National Commission for Men (on the lines of National Commission for Women) be set up to study issues of men.Suresh Ram, member of AIMWA, said, "For the third year since the association has been formed, we are reiterating the important and righteous demand before the government, but nothing seems to be moving in that way." Strongly demanding amendments into 84odd Acts and laws that has been seen by the association as antimen, Suresh said, "Most of them were used only to harass and blackmail men (by women), and 98 per cent of such cases were never led to conviction and finally they turned out to be fake complaints." The need for seeking national commission for men was to ensure rights and other privileges given to men in the society, he added.

CHANDIGARH: On Friendship Day, the Save Indian Family foundation (SIFF) has launched a SMS campaign to warn the would be grooms to be ware of deadly weapon in the hands of bride grooms- Section 498 A of Indian Panel Code which has made marrying in India a crime.

“Filing a complaint under section 498A is as easy as ordering an idli sambar to a road side vendor and actually, it is easier—the vendor may refuse to provide the dish but the police cannot refuse to listen to bride grooms”, claimed the members of Save Indian Family foundation (SIFF). 

A SIFF spokesman said, their aim is to make aware of the consequence that a man can face marrying in India. The SMS campaign, which was carried throughout the day targeted the people of Chandigarh, its counterparts, Punjab and Haryana. Thousands of SMSs were sent, saying, “If men in India wish to face the threat of losing their jobs and social status, then they should consider marrying in India. If you marry in India, then you have to abide by the laws of the land," stated SIFF.

“As far as revision of the law is concerned, National Commission for Women (NCW) maintains that strict dowry law is the sole way to ensure women empowerment and this is the only way to instigate the police and judiciary to get working. 

SIFF through the SMS campaign warned the people to be careful of the Indian dowry laws and its misuse”, said Gaurav Saini. 

The grooms targeted under this law are mostly wealthy and highly educated doctors, engineers, scientists and businessmen who are highly successful and have proven themselves in the career front. These people are threatened by the unscrupulous wives in collusion with the police to shell out crores of rupees as compromise amounts or find their names alongside dreaded international terrorists or drug smugglers.

“Such campaigns will continue in the coming future”, said the organisation.

New Delhi, July 28: Disclosure on its mind, an umbrella group of male rights NGOs has demanded that the sexual harassment at workplace bill be rewritten and made gender-neutral to protect men from harassment.

The Save Indian Family Foundation claims the bill has been prepared on the flawed premise that “women never lie and all the men are born a criminal” at a time men are also becoming victims of sexual exploitation.

The argument has echoes of the 1994 Hollywood thriller in which Michael Douglas’s character sues a colleague, played by Demi Moore, over sexual harassment.

The bill, prepared by the women and child development ministry and in the pipeline for the past five years, is to be introduced in the current session of Parliament.

The male rights NGOs under the foundation want the bill discarded and a fresh gender-neutral draft prepared. They have alleged that the women and child ministry, now headed by the Congress’s Krishna Tirath, is “sexist” and should be taken out of the picture. The new blueprint should be jointly drafted by a group of ministries, the NGOs have said and even demanded a separate ministry for men’s welfare.

“The bill must be reviewed and amended immediately to make it gender-neutral. In its present form, it is a violation of Article 15 (of the Constitution), which prohibits discrimination on grounds of religion or sex,” said foundation general secretary Niladri Shekhar Das. He plans to write to the Prime Minister with the demands.

The main grouse of male rights activists who are part of the foundation is that women have been given “unnecessary legal powers” and that the bill is in its current form is “unacceptable for a sane and just society”.

The bill says offices must have committees on sexual harassment, with the majority of their members women, including the chief. But the activists want such committees to have equal number of men and women. Such panels already exist but were set up following a Supreme Court judgment over a decade ago. The bill seeks to put in place the legal framework for the committees’ formation and functioning.

Students, research scholars, patients and women in the unorganised sector have been brought within the ambit of the proposed law. These segments were not specifically listed in the apex court order.

The activists have objected to one of the pre-qualifications required for a person to be a member of the office sexual harassment panels: that he or she shall be committed to the cause of women. “How can a male expect justice when he is being judged by a bunch of feminists,” asked Bishnu Pradhan, who is part of the foundation.

According to Pradhan, the bill overlooks the fact that women can be perpetrators too, and absolves them from prosecution for committing the same offence that it seeks to prevent men from committing.

Men are increasingly becoming victims of sexual crimes by women and drafting laws based on hallucinated assumptions can lead to disastrous social consequences, the activists have contended.

They have criticised the women and child development ministry’s stance that “the overwhelming nature of sexual harassment is against women and that the harassment of men cannot be put on the same footing, character-wise or incidence-wise”. “Since the laws drafted by the women’s ministry will only lead to gender imbalances, it must be removed from the process,” another activist said.

In blatant violation of all the above rights, thousands of husbands and their families are arbitrarily arrested every year, without evidence or investigation, under IPC Sections 498A, 304B, Dowry Prohibition Act, and related wife-centric laws which presume that the accused are “guilty until proven innocent”.

National Human Rights Commission (NHRC) has noted the misuse of dowry laws, arrest of innocent individuals and the resultant overcrowding of prisons. NHRC has urged the judiciary and law enforcement agencies to take measures against these abuses. High Courts across the country and the Supreme Court have condemned the misuse of dowry laws. The Commissioner of Police, Bangalore had issued standing instructions vide memo to check arbitrary arrests. The DGP, Karnataka has also issued a circular to implement 11 guidelines issued by Honorable Supreme Court of India regarding arrests and detention of Individuals in Cr WP No. 539/1986 and Cr WP No.592/1987. By taking note of the heavy misuse of the 498A IPC, recently on October 20, 2009, Union Ministry of Home Affairs had issued an advisory to all the state Governments and Union Territories. National Commission of Human Rights also has issued guidelines regarding arrests.

Nevertheless, abuse of police powers continues and unnecessary arrests have only been growing in the State of Karnataka. Police routinely enter people’s homes at ungodly hours, take accused men and women into custody, and incarcerate them in the name of “protecting women from cruelty and harassment”. Innocent citizens are illegally detained, humiliated, subjected to mental and physical torture, blackmail and extortion. The honor and reputation of these accused individuals is simultaneously attacked through media trial and unrestrained slander by women’s organizations every day. Thousands of men and women have been driven to suicide due to the trauma of false cases, arrest, prolonged trials and the resultant humiliation and financial troubles they have to endure.

According to statistics published by the National Crime Records Bureau in 2007 alone, an overwhelming 94% of the individuals arrested under IPC Section 498A were found not guilty. A closer look at individual cases under Section 498A reveals that arrests are made by lower cadre police officials without proper justification and only with the intent of terrorizing innocent citizens and extorting money from them under the threat of imprisonment and long-drawn legal battles.

Our numerous pleas to the Government of India to stop arbitrary arrests of citizens under IPC Section 498A have fallen on deaf ears. On the other hand, new laws are always on the anvil (sexual assault, work place harassment, acid attacks etc.) which stress on immediate arrest of men upon mere accusations made by women.

While it is amply clear that under the prevailing circumstances, arrest is inevitable for any man facing allegations of abuse or assault, it is imperative that innocent citizens are prepared to go to jail even if they committed no crime. Ordinary law abiding citizens and their kin should be freed from the fear of jail and the concomitant feelings of humiliation and suffering so that they do not drive themselves into depression, ruin their health or end their own lives.

All India Forgotten Women's Association and All India Men's Welfare Association, hereby, announce their support to Mr. Ravindra Gangurde's "Jail Bharo Andolan" as a sign of protest against arbitrary arrests of ordinary law-abiding citizens under IPC Sections 498A, 304B, Dowry Prohibition Act and related laws. We submitted a letter today to the Commissioner of Police, Hyderabad to request for permission to stage a peaceful demonstration.

In light of the above facts, we, the All India Forgotten Women's Association (AIFWA) and All India Men's Welfare Association (AIMWA), extend our support to Mr. Ravindra Gangurde, who has called for a "Jail Bharo Andolan" on 6 July 2010. On behalf of our fathers, brothers and sons, we sought the permission of the Commissioner of Police, Hyderabad, to conduct a peaceful demonstration (of not more than 50 persons) near the Women Police Station, CCS, Hyderabad, between 10:00-11:00 a.m. on 6 July 2010 and personally submit a memorandum.

Young boys were sexually harassed by employer-Driver told TV channel Nanda did 'bad things'

Indian goverment does not recognise that boys/men are also (can be ) sexually harassed exploited assaulted which is evident from the fact that the proposed SEXUAL HARASSMENT AT WORKPLACE BILL ( SHWB) is HEAVILY GENDER BIASED and gives protection to only girls/women against such sexual behaviour. However in reality such kind of abberant sexual behaviour can be mainifested by both gender equally towards either gender.

But since there is neither a MENS’ WELFARE MINISTRY nor NATIONAL COMMISSION FOR MEN that can cater to addressing the problems/concern HENCE all laws that are passed, under the pressure from radical feminist, in present times are women centric and blatantly ignore the rights of men as class/clan and are resultantly destroying the INDIAN socio cultural fabric.

It is urged that the SEXUAL HARASSMENT AT WORKPLACE BILL be MADE GENDER NEUTRAL

 

 

Driver told TV channel Nanda did 'bad things'

NEW DELHI: Moments before his death in Safdarjung Hospital on Thursday , the 41-year-old driver of industrialist Anil Nanda made some starting revelations before a television camera. Though the police have registered a murder case, it hasn't yet questioned Nanda or his associates.
"If I speak the truth, I will not live," says the driver on camera before giving details of the espionage work given to him. He also speaks about the allegedly dangerous nature of Nanda, the younger son of industrialist H P Nanda, and the "bad things" that allegedly happened at his Friends Colony residence. He claims that people are exploited there (he uses the word "soshan").

IBN 7 showed the driver in hospital bed speaking of gay sex in the house. He alleged that boys were paid by Nanda for having sex with him. He also claimed that Nanda forced his employees to have sex with him and if anyone refused, he threatened them with dire consequences. Despite repeated attempts, Anil Nanda was not available for comment.

Sudhir Sood, one of Nanda's employees said, "We are not aware about any allegations. It was an unfortunate incident. Sharma was a good worker and was working as driver of the escort vehicle of Anil Nanda. We are cooperating with the police in the investigations of the case." He further said that Nanda would not like to comment on the case and he does not deal with the employees directly.

No arrest has been made in this week-old case so far. The driver's family are alleging that the police is under pressure and are not acting against the "influential accused". Sharma's younger brother Yogesh said: "The police did not do anything. Despite our repeated requests, my brother's statement was not recorded before a magistrate. My brother had objected to the goings-on at the place where he worked. This cost him his life. He had expressed fear about his and his family's safety."

On its part, the police said that they were looking at the case from all angles. They have also received a letter from the driver's family, allegedly written by Janeshwar Sharma himself. The letter has more disturbing details, and the police is checking out its veracity. Asked about Sharma naming on camera Nanda and his two employees, Dhiraj Badani and Jitendra Pandey, the police claimed that these three were not present at the spot when petrol was poured on Sharma from behind and he was set alight. A police officer also said that Sharma had applied for a loan of Rs 3 lakh on June 3 and on June 4 Nanda had turned it down.
Additional CP (south east) Virender Singh Chahal said, "We have registered a case of murder and are investigating the matter from all possible angles."

In his statement to the police, Sharma had said that he was asked to tail a business partner of Nanda's, Vijay Sinha. However, he was caught by Sinha and scolded. He was asked to confess on whose behalf he was tailing Sinha. The FIR says that to a question asked by the police, Sharma replies: "It is a long story and I cannot reveal it now." Sharma also added that he didn't see his attacker. The man came from behind, poured petrol on him and set him on fire. This happened at Nanda's bungalow at Friends Colony (west). While the police is being discreet as it carries out its investigation, an officer said that if the letter written by Sharma turns out to be authentic, the case could take a dramatic turn.
